The death of 36-year-old Christopher Rodriguez at the Bellevue Hospital Outposted Therapeutic Housing Unit has raised serious questions about the medical care individuals in New York City’s correctional system receive. Rodriguez died on August 19, 2026, after being found in medical distress at the recently opened therapeutic housing unit, marking the first death at the facility and the sixth death in Department of Correction (DOC) custody this year.

The filing also seeks class-action status on behalf of other incarcerated individuals who allegedly experienced inadequate or delayed medical care while in New York City correctional facilities. The proposed class action seeks to represent individuals incarcerated in New York City correctional facilities, including Rikers Island, who allegedly received inadequate or delayed medical care, had medical complaints ignored or improperly treated, were denied timely medications, or were subjected to verbal or physical abuse by correctional staff. The filing alleges these are systemic issues affecting hundreds of inmates and contends that Rodriguez’s claims are representative of others who suffered similar harm.
The Notice of Claim alleges that Rodriguez suffered from underlying medical conditions and that failures in medical treatment, staffing, supervision, and emergency response contributed to his death. It further alleges broader systemic deficiencies affecting other detainees requiring medical care. These allegations have not been adjudicated.
