Our client, a 35-year-old male was working out with a trainer at an Equinox gym. The trainer is supposed to be watching the exercises, correcting, and have his hands beneath free weights in case they fall or are otherwise problematic. Our client was lying on his back with a large dumbbell in each hand. He lost focus and lost control of one of his dumbbells and the trainer was not paying attention and the dumbbell struck a man in the face, fracturing his jaw. It settled in our favor for $135,000.
